Concerns about conflict of interest in the delivery of Medicaid long-term services and supports (LTSS) resulted in new rules promulgated by the Centers for Medicare and Medicaid Services (CMS) in 2016 that attempt to provide clarity and guidance around this thorny topic. The CMS regulations respond to the contention that conflict may occur when a community-based organization (CBO) serves as both the agency assessing the need for services and delivering the services.
